LIVERMORE — Cleanup crews from the Environmental Protection Agency contained a mercury spill Thursday that ended up in a carport and a gutter in a Livermore neighborhood. About 3 p.m. Wednesday, authorities received reports of metallic beads in the gutter in front of the 900 block of Olivina Avenue, said Glen Haendel of the Livermore Fire Department. Richard Martyn, an on-scene coordinator for the EPA, said that the thousands of beads were roughly the size of pinheads.

Hans Reisers murder trial resumed Monday with Nina Reisers divorce attorney, Shelley Gordon, on the stand for much of the day. Gordon represented Nina Reiser for two years before Nina Reiser, 31, went missing on Labor Day weekend 2006. On the stand, Gordon described Reiser as a man unwilling to agree with Nina Reiser on the childrens schooling, health care, even the type of video games they played. He also failed to pay a court- ordered $5,400 monthly family support payment for 10 months, Gordon said. The amount was eventually reduced to a flat $15,000 but that money was never paid, she said. On Aug. 25, 2006 _ about a week before Nina Reiser disappeared _ a trial date for the contempt of court matter was set for Oct. 11, 2006. Hans Reiser was advised that he could go to jail if found in contempt of court, Gordon said. “Did that Oct. 11 date happen?” Alameda County Prosecutor Paul Hora asked Gordon.

Lawyers need courage and compassion as personal virtues. But lawyers may need these virtues in ways that they had not imagined when they first entered the Bar. Statistics about lawyers are alarming. I have read that 40-50 percent of disciplinary cases involve lawyers who are suffering from an impairment, usually an addiction to alcohol or drugs. I have read that lawyers are twice as likely as other Americans to have an addiction, depression, suicidal tendencies, or stress anxiety. To be more concrete, I have read that 10 percent of Americans suffer from an addictive, emotional, or mental impairment. By contrast, these same sources estimate that 20-25 percent of lawyers suffer from an impairment. If this is true, it means that in Oklahoma at least 2,000 lawyers are practicing who are impaired. Two thousand lawyers who likely do not realize that they need to be courageous and compassionate toward themselves. Lawyers need courage to say, “I am an alcoholic,” or “I am addicted to drugs.” Lawyers need courage to say, “I am emotionally exhausted by my divorce,” or “I am overwhelmed with grief at the death of my child,” or “I am debilitated by too much work.” Once lawyers are courageous with themselves, they can be compassionate to themselves by seeking assistance to address these burdens. But not all lawyers individually will either have the insight or the courage to face the fact that they are suffering from an impairment. In those instances, their fellow lawyers must have the courage to speak the truth to the impaired lawyer. Fellow lawyers must not turn away from the impaired lawyer in the ill-advised hope that all will be OK somehow. Fellow lawyers show compassion for an impaired lawyer not by ignoring the lawyers impairment but by helping that lawyer to get needed assistance. Moreover, by acting with courage to assist an impaired lawyer, fellow lawyers can often prevent serious harms from occurring either to the impaired lawyer or to the impaired lawyers clients. Once harm occurs to clients, fellow lawyers have the obligation to report the impaired lawyer to disciplinary authorities for misconduct. Where can a lawyer with an impairment, or fellow lawyers desiring to assist, go for help? Since 1985, the Oklahoma Bar Association has supported the Lawyers-Helping-Lawyers Committee. For 12 years, the volunteer members of this committee have provided confidential, immediate responses to those who call for help. Volunteer members arrange a meeting to discuss the situation and to offer suggestions for further treatment — be it counseling, admission to a treatment center, or joining a 12-step program. Volunteer members will serve as a sponsor to meet with the impaired lawyer as often as necessary to get the lawyer on the road to recovery. Lawyers-Helping-Lawyers has the goal of recovery, not discipline. Beginning in January, the Oklahoma Bar Association committed $18,000 to match $18,000 provided by the Oklahoma Attorneys Mutual Insurance Co. to hire a part-time director for the committee. As described by the Lawyers-Helping Lawyers Committee, the director will develop treatment plans, conduct counseling sessions, make lawyer evaluations and referrals, maintain a 24-hour hotline, coordinate the activities of the committee volunteers and develop educational programs for the Bar about impairment. In addition, the director will identify professionals from other disciplines who have the skills and the desire to work with lawyers suffering from an impairment. This year is the first year that Lawyers-Helping-Lawyers has had a staff member devoted to its tasks. While the arrangement at present is only for a one-year trial period, Lawyers-Helping-Lawyers is hopeful that the trial period will convincingly show the need for a full-time director on a permanent basis beginning in 1999. Lawyers-Helping-Lawyers has acted with courage and compassion to face an issue that has not received the attention that its seriousness deserves. Lawyers are suffering; clients are at risk; the profession bears the stigma of attorneys who commit misconduct while impaired. For ourselves, our clients, and the profession, we, the organized Bar, need to say, “We, my brother and sister lawyers, are human. We are impaired. Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. Many of the trucks you see on the roads today are insured on one of three commercial auto insurance contracts: the truckers form, the motor carrier form or the business auto form. The truckers form is used for firms hauling only goods owned by others. The motor carrier form insures firms hauling both their own goods and the goods of others. The business auto form is used to cover firms hauling only goods that they own. The Insurance Services Office, Inc. (ISO), promulgates all three contracts. We will discuss the exclusions under the business auto policy and how to provide coverage for the excluded risks. To do so, we will consider several examples. In a fictitious example, MBF Corp.s (MBF) annual planning conference was going to be held at a mountain lodge. Conference attendees from all over the country would need to fly into a nearby town, rent four-wheel drive vehicles and drive about 20 miles to the lodge. The last five miles of the route required four-wheel drive vehicles because there was no pavement, only a trail created by vehicles driving over the mountain terrain. In therapeutic interviews described as either hypnosis or biofeedback, the patient must change mental imagery to achieve the desired state or physiologic change. If the therapists monitors physiologic measures while coaching a patient through a self-hypnotic exercise, invariably there will be changes in measures (e.g., increased peripheral temperature, decreased pulse rate). Regardless of the confusion, the benefit of adding physiologic monitoring (biofeedback) to hypnosis is the enhancement of a sense of personal control and competency. Children recognize that by changing their thinking, they can impact body processes. This makes the experience more concrete and provides trance ratification and gives a child increased confidence about achieving the desired therapeutic outcome. Irritable bowel syndrome (IBS) is common, with each UK GP seeing an average of about eight patients every week. It is unpleasant for sufferers, negatively affects quality of life, and is expensive for health services. A large proportion of patients do not do well with conventional therapy, and many seek unconventional alternatives. One of these is a form of hypnotherapy known as gut-directed hypnotherapy. It is based on relaxation to try to normalise gut function. Because there are claims that it works, some purchasers are tempted to provide a service. A systematic review of trials [1] suggests a large degree of caution is warranted. Authors sought studies, of any design, in nine electronic databases, and even contacted authors for information about any further studies.
The authors note that there have been 13 studies which used prospective randomized control designs which compared hypnosis either to baseline level noiception or to a control condition of some sort. These studies consistently demonstrate that hypnosis can assist patients with chronic pain with a reduction in their pain experience and pain related coping for a variety of chronic pain conditions. Hypnosis was generally found to be more effective than other nonpharmacological interventions such as physical therapy, attention, and psychoeducative strategies. The intervention which was most commonly employed was training in self-hypnosis. The authors provide a critique of these studies in that there appears to be a lack of standardization in the uses of hypnotic interventions in these clinical trials and also that the treatment group numbers tended to be lower than one might desire. The authors also provide a number of very useful suggestions for future research and clinical application of hypnosis to assisting patients with chronic pain syndromes. Universal Laser Systems Inc. ULS says it has the industrys smallest 10-watt C[O.sub.2] laser at only 13.5 in, by 2.8 in. by 3.85 in.; the basic OEM version of the laser weighs 7.25 lbs. With an integrated RF supply, the laser can be retrofitted to previous 10-watt C[O.sub.2] installations, the company adds. Communications media networks were born with the 1926 radio sign-on of the National Broadcasting Company (NBC) signaling the dawn of a new era of both communications and culture in America. The network concept is purely abstract–even in its practical form nothing but a series of wires or satellite connections. Yet the history and influence of the broadcast networks is one of the great stories of the twentieth century for though they did not create it the networks did cement the process of homogenizing American culture. By 1930 for the first time America was whistling to the same tunes laughing at the same comedians hearing the same politicians speeches–instantaneously. The taste and judgement of a relative few urban Northeastern network executives set national standards of everything from dialect and language to fashion and behavior. Only when the influence of the old-line networks had faded by the end of the century was it truly possible to grasp the power they held over the nation for so long.Though the number of networks has grown exponentially over the decades with the technology of their distribution methods improving by light-years the concept has remained the same. A network is simply a set of affiliate stations that receive programming from one central source then beam that programming by some method either broadcast wave or cable wire into the eyes and ears of a waiting public.

Sir: I suspect that the earliest example of road rage is in fact that displayed by the Sumerian hero Gilgamesh, who predates Greek and Biblical offenders by hundreds of years. Just before the famous account of the flood, we read that as he is walking down the road towards the sea, looking for eternal life, a young woman tells him he cannot go on. “Seized with anger”, he snatches an axe and a dagger, rushes down and damages the boat. After “talking it over” with the boatman, however, he calms down and agrees to build a replacement craft. Is this the earliest reference to road rage counselling and community service for offenders?

Dr. Williams addiction to treating patients in Third World countries has been a blessing to countless people in need of reconstructive surgery over the past seven years. The good doctor has taken a leave of absence from his regular position at least once each year to travel to areas of the world where plastic surgeons simply dont exist. Whats more, he pays for most of his travel expenses out of his own pocket. Over the years, he has traveled to Bolivia, India, Kenya, Mexico, Pakistan, Peru, the Philippines, and Vietnam. What compels a doctor who, in the words of a colleague quoted in the Idaho Statesman article, could be making $1 million a year, to spend his time and money treating patients too poor to pay? The only answer can be true compassion for suffering children and a desire to help those less fortunate than himself. In most of the Third World countries where Dr. Williams serves, medical practice is limited to essential lifesaving–plastic surgery is an unheard-of luxury. Many children in such areas born with cleft palates or other disfiguring birth defects, or those disfigured by burns, have resigned themselves to their fate in life. The parents of such unfortunate children have often abandoned hope that their children will ever appear normal. Dr. Williams has also trained many physicians in the countries he visits in his art so that they can continue to treat patients he is unable to reach. As he told the Statesman, When you can teach the local people to do the work, youre not just treating the patient, youre solving the problem.
When most people think of plastic surgeons, they imagine facelifts, liposuction, and tummy tucks–but ask a soldier injured in Iraq and he or she will tell a different story, relates the American Society of Plastic Surgeons, Arlington Heights, Ill. Plastic surgeons work alongside other surgeons and physicians in combat support hospitals to address the immediate needs of the injured. Because of the severity of many war wounds, plastic surgery is not performed in the field. Instead, they treat the wound first to ensure it is free from infection and then fly the soldier home to receive additional medical and reconstructive measures. Homemade roadside bombs and high-velocity guns pose the biggest threats to soldiers in Iraq, notes Friedman. The most common injuries are wounds in the lower and upper extremities as well as the face. Although soldiers wear body armor with built-in plates, the arms, face, and legs remain exposed. Helmets protect the head but leave the face susceptible to injury.

The Lying Game James W. But insecurity can be turned into opportunity, at least for small and medium-sized enterprises. Of course there has to be the usual disclaimer that every trade is different, but there are several common themes. The general principle that links them is that uncertainty helps the small and nimble at the expense of the large and sluggish. For example, one of the effects is for larger companies to outsource more. The greater the insecurity about future demand, the greater the need to reduce fixed costs. This creates opportunities for smaller firms to spring up to service the larger ones. Another effect is that new niches emerge. Changing technology has created lots of opportunities for companies that service the new technologies - help on websites has been perhaps the most obvious example - but the greater the uncertainty the more all businesses need to find niches where profitability will not be savaged. They cannot necessarily find these niches themselves, so they need help.

Whitefish Bay For more than 50 years, Helen VerBurgs hands have crafted gifts of nature into elegant artwork. She has transformed ostrich eggs into Victorian jewelry boxes, emu eggs into elaborate wedding cake toppers and even minuscule finch eggs into exquisite objets darte. Although a stroke has slowed this active 89-year-old woman, she has handed down her love for the ancient artistry of Faberge-style eggs to her 29-year-old granddaughter, Bernadette VerBurg.
There seems to be a resurgence in products for baking. The news, though, is that they all simplify baking even further for the consumer. One of the latest products launched is Pillsburys(Minneapolis) Treat Toppers frosting. It comes in a squeeze bottle and is designed to be a decorating tool (consumers can squeeze out small amounts of frosting in order to make designs on a cake). [ILLUSTRATION OMITTED]

Plants and Projects International Paint Inc. has commissioned a new production plant at its Houston, TX, site. The facility, which produces heavy-duty marine and structural steel coatings, incorporates six new manufacturing lines for thin-film products and seven for high-build epoxies.

Nashville, Tenn. - TNN canceling several series — The Nashville Network is canceling some country music-oriented programming, including the talk-variety format that has been its prime-time flagship for 16 years. Executives at the cable network Monday confirmed reports that “Prime Time Country with Gary Chapman” would stop production in September. Three entertainment magazine shows that focus on country singers also are being canceled: “Crook Chase,” “Crook Chase Tonight” and “This Week in Country Music.”

GuitarReferences to guitar-like instruments date back many centuries, and virtually every society throughout history has been found to have used a variation of the instrument. The forerunner of todays guitars were single-string bows developed during early human history. In sections of Asia and Africa, bows of this type have been unearthed in archaeological digs of ancient civilizations. Interestingly, one of these discoveries included an ancient Hittite carvingdating back more than 3,000 yearsthat depicted an instrument bearing many of the same features of todays guitar: the curves of the body, a flat top with an incurred arc of five sound holes on either side, and a long fretted neck that ran the entire length of the body.

Science for Lawyers
Lawyers need courage and compassion as personal virtues. But lawyers may need these virtues in ways that they had not imagined when they first entered the Bar. Statistics about lawyers are alarming. I have read that 40-50 percent of disciplinary cases involve lawyers who are suffering from an impairment, usually an addiction to alcohol or drugs. I have read that lawyers are twice as likely as other Americans to have an addiction, depression, suicidal tendencies, or stress anxiety. To be more concrete, I have read that 10 percent of Americans suffer from an addictive, emotional, or mental impairment. By contrast, these same sources estimate that 20-25 percent of lawyers suffer from an impairment. If this is true, it means that in Oklahoma at least 2,000 lawyers are practicing who are impaired. Two thousand lawyers who likely do not realize that they need to be courageous and compassionate toward themselves. Lawyers need courage to say, “I am an alcoholic,” or “I am addicted to drugs.” Lawyers need courage to say, “I am emotionally exhausted by my divorce,” or “I am overwhelmed with grief at the death of my child,” or “I am debilitated by too much work.” Once lawyers are courageous with themselves, they can be compassionate to themselves by seeking assistance to address these burdens. But not all lawyers individually will either have the insight or the courage to face the fact that they are suffering from an impairment. In those instances, their fellow lawyers must have the courage to speak the truth to the impaired lawyer. Fellow lawyers must not turn away from the impaired lawyer in the ill-advised hope that all will be OK somehow. Fellow lawyers show compassion for an impaired lawyer not by ignoring the lawyers impairment but by helping that lawyer to get needed assistance. Moreover, by acting with courage to assist an impaired lawyer, fellow lawyers can often prevent serious harms from occurring either to the impaired lawyer or to the impaired lawyers clients. Once harm occurs to clients, fellow lawyers have the obligation to report the impaired lawyer to disciplinary authorities for misconduct. Where can a lawyer with an impairment, or fellow lawyers desiring to assist, go for help? Since 1985, the Oklahoma Bar Association has supported the Lawyers-Helping-Lawyers Committee. For 12 years, the volunteer members of this committee have provided confidential, immediate responses to those who call for help. Volunteer members arrange a meeting to discuss the situation and to offer suggestions for further treatment — be it counseling, admission to a treatment center, or joining a 12-step program. Volunteer members will serve as a sponsor to meet with the impaired lawyer as often as necessary to get the lawyer on the road to recovery. Lawyers-Helping-Lawyers has the goal of recovery, not discipline. Beginning in January, the Oklahoma Bar Association committed $18,000 to match $18,000 provided by the Oklahoma Attorneys Mutual Insurance Co. to hire a part-time director for the committee. As described by the Lawyers-Helping Lawyers Committee, the director will develop treatment plans, conduct counseling sessions, make lawyer evaluations and referrals, maintain a 24-hour hotline, coordinate the activities of the committee volunteers and develop educational programs for the Bar about impairment. In addition, the director will identify professionals from other disciplines who have the skills and the desire to work with lawyers suffering from an impairment. This year is the first year that Lawyers-Helping-Lawyers has had a staff member devoted to its tasks. While the arrangement at present is only for a one-year trial period, Lawyers-Helping-Lawyers is hopeful that the trial period will convincingly show the need for a full-time director on a permanent basis beginning in 1999. Lawyers-Helping-Lawyers has acted with courage and compassion to face an issue that has not received the attention that its seriousness deserves. Lawyers are suffering; clients are at risk; the profession bears the stigma of attorneys who commit misconduct while impaired. For ourselves, our clients, and the profession, we, the organized Bar, need to say, “We, my brother and sister lawyers, are human. We are impaired.
